A springing power of attorney only becomes effective once one or more physicians certify that you have lost capacity. Springing documents offer peace of mind for clients who are uncomfortable granting authority right away, but they can create delay and friction at the exact moment your family needs quick action. Choosing the Right Agent

Your agent should be someone who is financially responsible, available, and willing to act in your best interest, not necessarily your oldest child or closest relative. Can I revoke a power of attorney after signing it?

Yes. As long as you have capacity, you can revoke a power of attorney at any time by executing a written revocation and notifying your agent and any institutions relying on the document. We recommend reviewing your power of attorney every few years and after any major life change, such as a divorce or the death of your named agent.

Does a power of attorney let my agent make medical decisions for me?

No. A power of attorney under Probate Code section 4000 covers financial and legal matters only. Medical decision making authority is handled through a separate Advance Health Care Directive, which we typically prepare alongside your financial power of attorney.
