Probate Administration Over Four Decades of Experience Working Towards Your Goal

Los Angeles Probate Administration Attorney

Guiding Executors and Families Through the Court Process

Probate is the court-supervised process of validating a will (or applying intestate succession law if there is none), paying the decedent's debts and taxes, and distributing what remains to the rightful beneficiaries or heirs. It is required whenever a decedent held enough California assets in their individual name, above the small estate thresholds, without a trust or other probate-avoidance planning in place.

With over four decades of experience, Mitch Port has guided Los Angeles families and executors through the Los Angeles County Superior Court probate process for estates of every size and complexity.

The Probate Process, Step by Step

Probate begins with filing a petition to admit the will (or open an intestate administration) and to formally appoint the executor or administrator, who then receives Letters Testamentary or Letters of Administration from the court. The personal representative must then take an inventory and appraisal of estate assets, working with a court-appointed probate referee for non-cash assets, provide formal notice to creditors and give them an opportunity to file claims, pay valid debts and applicable taxes, and eventually file a petition for final distribution once the court is satisfied the estate has been properly administered.

How Long Probate Takes and What It Costs

A straightforward, uncontested probate in Los Angeles County typically takes nine months to a year and a half from filing to final distribution, though estates with real property sales, disputes among heirs, or tax complications can take considerably longer. California sets statutory attorney and executor fees under Probate Code sections 10800 and 10810, calculated as a percentage of the estate's gross value, meaning the fees are the same regardless of which attorney is retained. We make sure clients understand these statutory fees up front, along with any additional fees for extraordinary services, such as litigation or the sale of real property.

Avoiding Common Pitfalls

We see families run into trouble when they distribute assets before the creditor claim period has closed, fail to properly notice all interested parties, or attempt to handle the inventory and accounting without professional guidance, only to have the court reject the accounting and delay the case further. Working with an experienced probate attorney from the outset helps keep the case moving efficiently and reduces the risk of personal liability for the executor or administrator.

Frequently Asked Questions

Is probate always required in California?

No. Probate is generally required only when the decedent held assets in their individual name exceeding California's small estate thresholds, which currently allow estates valued at $239,700 or less in personal property, and up to $750,000 for a qualifying primary residence, to use simplified procedures instead.

Who can serve as executor if the will does not name anyone able to serve?

If the named executor is deceased, unwilling, or unable to serve, the court will appoint an administrator, typically prioritizing a surviving spouse or other close family member, following the priority order set out in the Probate Code.
